Teck Inc, a Canadian mining company was notified this week that their appeal against a decision made in favor of a landmark environmental case for the Colville Confederated Tribe was denied by the Supreme Court according to the Tribal Tribune.
It was determined the mining company was the responsible party in polluting the Upper Columbia River with toxic waste. This legal precedent established that federal environmental law will be upheld against a Canadian company when hazardous substances cause pollution over the border into the United States. Due to this decision, the Tribes will recover $8.5 million dollars accrued in attorney fees and scientific investigation against Teck
The Colville Tribe and the State of Washington have acted as co-plantiffs against Teck since 2004 and they condemned the mining company for dumping slag and other toxic waste into the Upper Columbia River for almost 100 years.
